GENERAL CONDITIONS
1. Object
These General Terms and Conditions of Sales (GTC) regulate the distance selling and, as far as compatible and not otherwise derogated, the non-distance buying and selling of tickets, passes or other titles necessary for the use of the services displayed on the Site, carried out by CED Digital in the name and on behalf of the organizers of the aforementioned services.
2. Definitions
The following definitions apply to these CGC, it being understood that the definitions in the plural will apply to the relative term in the singular and vice versa:
Application / Rome & Vatican City Card / or APP: indicates the applications for mobile devices referable to CED Digital that allow the purchase of Access Tickets.
Consumer Code: indicates the Legislative Decree 6 September 2005, n. 206.
Consumer: means the Customer as a natural person who acts for purposes unrelated to the entrepreneurial, commercial, craft or professional activity that he/she potentially carries out.
Sales Contract: indicates the contract that is concluded, as a result of the CED Digital Services, between the Customer and the Organizer whose object is the buying and selling of the Admission Pass, governed by these GTC and the information provided on the Site, before the conclusion of the contract, also, pursuant to and for the purposes of the articles 49 et seq. of the Consumer Code.
Customer: means the subject who, as a result of the CED Digital Services, buys the Admission ticket from the Organizer, remotely – via the Site, through the App or by telephone sale, or not remotely, at CED Digital Stores.
Contract: means the CED Digital Services Contract and the Contract of Sale.
Main Service: indicates the service to which the Admission Pass’s owner has the right to access.
Organizer: indicates the organizing subject of the Service, in the name and on behalf of which CED Digital acts, whose identification details are given, in the “Information” section of the Site.
The Admission Pass’s owner: means the person who legitimately holds an Admission Pass purchased by the Customer in accordance with these General Terms and Conditions.
CED Digital Sales Points: indicates the sales network affiliated to CED Digital.
Site: indicates the romevaticancard.com site, owned and operated by CED Digital.
CED Digital: indicates CED Digital & Servizi S.r.l., with registered office at Barberini 28 – 00187 Rome (Italy); tel. +39 06 45412200 email marketing [@] cedsdigital.it, which under the Contract of Sale acts in the name and on behalf of the Organizer.
Admission Pass: means the document, also in digital format, issued by the Organizer or by CED Digital in the name and on behalf of the organizer, which legitimizes the Holder of the Access Title to use the Services.
CED Digital Services: indicates the services provided by CED Digital through the Website, concerning the booking of the Access Title, the delivery or other forms of making available to the Customer the Admission Pass as well as additional accessory services relating to the sale of the Admission Pass, where requested by the Customer, but excluding, in any case, the provision of the service corresponding to the Main Service, which is the exclusive responsibility and responsibility of the Organizer.
3. Scope of application
3.1 The offer and sale on the Website of the Access Titles constitutes a distance contract governed by Chapter I, Title III (articles 45 et seq.) of the Consumer Code and by Legislative Decree 9 April 2003, n. 70, containing the regulation of electronic commerce.
3.2 These General Terms and Conditions may be modified at any time. Any changes will be effective from the time they are published on the Site in the “Terms and conditions of purchase” section, that is in the footer of each page of the Site. Users are therefore advised to regularly access the Site and consult the most updated version of the GTCs before buying.
3.3 The applicable Terms and Conditions are those in force on the date of transmission of the order to purchase an Admission Pass. Before proceeding to the conclusion of the Contract, the user is required to read carefully all the information that CED Digital provides on the Site, both before and during the purchase procedure, and to examine and approve these Terms and Conditions, by selecting the appropriate box made available to the user during the purchase process and before the conclusion of the Contract.
3.4 These GTC do not regulate the sale of products and / or services by parties other than CED Digital that are present on the Site through links, banners or other hypertext links. Before making commercial transactions with these parties, it is necessary to verify their sales conditions. CED Digital is not responsible for the provision of services and / or the sale of products by such parties. CED Digital does not perform any checks and / or monitoring on websites that can be consulted through these links. CED Digital is therefore not responsible for the contents of such sites nor for any errors and / or omissions and / or violations of the law by the same.
4. Purchases on the Site
4.1 The purchase of Access Tickets on the Site can take place only after registration on the Site in the manner set forth in art. 5 which follows and is permitted both to users who are Consumers and to users who do not possess this quality. Every natural person who has legal capacity and is at least 18 years old can purchase the tickets.
4.2 CED Digital upholds its right to refuse or cancel the orders coming from (i) a user with whom it has an ongoing legal dispute; (ii) by a user who has previously violated these Terms and Conditions and / or the conditions and / or terms of the Contract; (iii) by a user who has been involved in fraud of any kind and, in particular, in fraud related to credit card payments; (iv) from users who have issued false, invented, fictitious, incomplete or in any case inaccurate and / or in any way misleading identification data or referred to third parties or that have not sent to CED Digital the documents promptly requested by it under the procedure referred to in Articles 11.1.2 and 11.1.3 which follow or have sent invalid documents; (v) by a user who has violated the prohibition pursuant to art. 5.2 below.
5. Website Registration
5.1 To register on the Website and create the relevant account, the user must complete the appropriate form, entering the requested personal data, as well as an e-mail address and a password.
5.2 The user guarantees that the personal data provided to CED Digital, during the procedure for registering on the Website or, at any other time and / or occasion of its relationship with CED Digital, are complete, truthful and referred to the user himself. The user agrees to release and hold CED Digital harmless against any damage, indemnity and / or sanction deriving from and / or in any way connected to the violation by the user of the guarantee referred to in this article and / or the violation of the registration rules on the Website and / or on the retention of registration credentials. Each user can use only one registration on the Site. CED Digital reserves the right to close multiple accounts referable to the same physical and / or legal person, and / or to the same company and / or to the same entity.
5.3 The registration on the Site allows the user to carry out, through the confidential and personal account, among other things, the following activities:
– checking the status of the most recent orders and viewing the archive of all orders placed;
– managing their personal data and modifying them at any time;
– changing the password;
– managing the subscription to the “Newsletter” and / or “ticket alert” service;
– using dedicated services that can be activated from time to time by CED Digital.
5.4 The registration credentials (email address and password) allow the user to purchase on the Site and to carry out, among other things, the activities referred to in art. 5.3 above. They must therefore be preserved with extreme care and attention. They must be used only by the user and cannot be transferred to third parties. The user undertakes to keep them secret and ensures that no third party has access to them.
He also undertakes to immediately inform CED Digital, by contacting it at the addresses indicated in the “Contacts” section of the Website, if he suspects or becomes aware of any improper use or improper disclosure of the same.
6. Information towards the conclusion of the contract
6.1 In compliance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, CED Digital informs the user that:
1. a) in order to conclude the purchase contract of an Access Ticket on the Site, the user must fill in an electronic order form and send it to CED Digital, electronically, following the instructions that progressively appear on the site;
2. b) whether necessary, the sending of the order form must take place within the maximum time indicated on the Site;
3. c) the contract is concluded when the order form reaches CED Digital server;
4. d) before transmitting the order form, the user should identify and correct any errors in data entry by following the instructions on the Site in the various stages of the purchase;
5. e) once the order form has been registered, CED Digital will send to the Customer, to the email indicated address, the confirmation of the order containing: the essential information relating to the access ticket purchased, the detailed price indication, the delivery costs and any additional costs, the delivery terms as well as information relating the Customer Service contacts that the user can contact to request assistance and / or lodge complaints. The order confirmation email, which contains a link to the GTCs, constitutes the confirmation of the concluded contract on a durable medium pursuant to art. 51, paragraph 7, Consumer Code; the Customer acknowledges and expressively agrees that, once such e-mail has been sent, CED Digital has fulfilled its documentation obligations and that, therefore, the Customer is bound by the Contract and is certainly obliged to pay the Total Amount, regardless of the receiving of the order confirmation email, which depends on third parties and / or on factors that are beyond the control of CED Digital (e.g. email provider used by the user);
6. f) the order form will be stored in the CED Digital database for the time necessary for the execution of the same and, in any case, according to the law. The user can access the order form and / or the data related to the same through his personal account.
6.2 The languages available to users for the conclusion of the contract are Italian and English. Customer Service is able to communicate with users in these two languages.
7. Availability of Access Tickets
7.1 Regarding the Access Tickets that can be purchased through the Website, CED Digital reports and the user acknowledges and expressively agrees that, in relation to certain types of Main Services:
1. a) the package of Admission Passes that can be purchased through the Site is determined by the Organizer, which establishes the number, price and type of Admission Passes that must be offered for sale on the Site, also establishing whether the number of tickets that can be purchased by users on the Site through the relevant account is unlimited or if there is a maximum number of tickets that can be purchased per account and, in this case, indicating this number;
2. b) a number of users may attempt to purchase the same category of Access Tickets in relation to the same Main Service simultaneously;
3. c) all requests generated by pressing the “PUT IN THE CART” button and related to the same Main Service are processed in chronological order, based on the time of arrival of the request to the CED Digital Server;
4. i) the purchase of the Main Service selected by the user can, therefore, take place only if, at the moment the Server received the request generated by the pressure of this button there is still availability of the category of Access Titles request, taking into account the actions performed by other users whose request relating to the same Access Title has reached the Server at a time prior to that of the user.
8. Information on Access Tickets and reservations
8.1 The categories of Tickets for each Main Service are described on the Site.
The use of the Tickets is subject to specific terms and conditions established by the Organizer. The user is advised to check on the Organizers’ websites and on the “Information” section of the Site, the rules for the use of the individual Main Services, which form an essential part of this Agreement.
8.2 Given the fact CED Digital does not constitute an exclusive distribution network nor the subject managing sales decisions relating to a particular Main Service, CED Digital is not responsible for the type of sales services offered by the Organizer.
8.3 The use of Main Services may be subject to mandatory booking. The booking is managed independently by the Organizers and CED Digital has no responsibility for the relative process, although on the Site, for the sole purpose of facilitating the Customer, there may be links to the pages on which reservations can be made.
9. Access Tickets Price
9.1 The Price of the Access Tickets is set by the Organizer and is inclusive of any pre-sale rights set and applied by the Organizer itself.
9.2 The Price of the Access Tickets that is indicated on the Website is the last price communicated to CED Digital by the Organizer. The Organizer reserves the right to change the Price of the Access Tickets at any time, notwithstanding that, in the case of a purchase through the Website, the price that will be charged to the user will be that indicated on the Site and that any eventual account will not be taken into account changes (neither increasing nor decreasing) subsequent to the transmission of the order. So, any lower price that after the purchase by the Customer is applied by the Organizer to Tickets of the same type or with respect to Main Services to be held on a set date, will not give the Customer the right to get a refund of the difference.
9.4 In addition to the Price of the Access Tickets you may add, depending on the choices made by the user: (i) the home delivery costs of the Access Titles and / or printing at home; and / or (ii) gift wrapping costs; and / or (iii) any insurance coverage premium (“Additional Charges”). The amount of each of the Additional Charges, if applicable, is specifically indicated to the user in the Shopping Cart and in the Order Summary, together with the Total Amount. In the case of the Contract being concluded, it is also indicated in the order confirmation email.
9.5 The Price and Additional Charges are expressed in Euros and must be considered inclusive of VAT, where applicable.
10. Purchase orders
10.1 The effects of the Contract are conditional at the moment the Total Amount is paid. In the event that such payment does not take place, the contract will therefore be considered terminated by law. In this case, straight after the transmission of the order, the user will be immediately notified of this resolution and the consequent cancellation of the order via the Site.
10.2 The ownership of the Tickets will be transferred to the user upon conclusion of the Contract.
In the case of home delivery and / or collection at CED Digital Points of Sale, the risk of loss or damage to Access Tickets, for reasons not attributable to CED Digital, will be transferred to the user when the user or a third party chosen by the same and different from the carrier, enters materially into possession of the Access Tickets.
10.3 In order to send an order relating to an Access Ticket through the Website, the user must carefully read and approve, by selecting the appropriate box that is available during the purchase process, these GTCs.
11. Methods of payment
11.1 The payment of the Access Tickets purchased through the Website can be carried out by using the payment methods indicated on the Website. CED Digital reserves the right to apply, for security reasons, limitations and exclusions to the payment instruments that can be used by the Customer to pay for the Securities of Access. In the event of termination of the Sales Contract and in any other case of reimbursement, for any reason, the refund amount will be credited to the same payment method used by the Customer for the initial transaction; if this is not possible, the refund will be made by bank transfer. CED Digital will ask the Customer for the bank details necessary to make the refund.
11.2 CED Digital uses a secure payment service that uses the SSL security protocol. The credit card’s confidential data (card number, expiry date holder, security code) are encrypted and thus transmitted to the payment manager. CED Digital therefore has no access and does not store the credit card data used by the user for the payment of the Access Tickets.
12. Methods of withdrawal and delivery of the Access Tickets
12.1 The delivery of the Access Tickets purchased on the Site can be made as follows: (i) delivery to the postal address indicated in the purchase process (“Home Delivery”) and (ii) delivery by immediate printing of the Admission Pass (“Immediate Print”). The alternative or cumulative availability of the aforementioned delivery methods is at the discretion of CED Digital.
12.2 In the case of Home Delivery, the Access Tickets purchased on the Website will be sent and delivered to the postal address indicated by the user in the “Address” phase of the purchase process.
12.3 The times and costs of Home Delivery that vary, depending on the country of delivery and on the type of the chosen Admission Ticket, are indicated on the Website. The specific costs and Delivery Times at Home that are applied to a specific order are also indicated during the purchase process, before the user transmits the order, and in the case of conclusion of the Contract, in the order confirmation email.
The Home Delivery will be carried out on working days, during normal office hours, excluding Saturdays and national holidays. The delivery obligation is considered fulfilled through the transfer of the material availability or in any case the control of the Client Access Certificate.
12.4 At the time of shipment, the Customer will be sent an email confirming that the carrier has taken charge of the shipment, which will also contain the shipping code / tracking number by clicking on which the Customer could check the status of the shipment.
12.5 Home Delivery is subject to payment and, unless otherwise specified, the Customer is charged with the delivery costs. The amount of delivery costs the user must pay in relation to a specific order is expressly and separately indicated (in Euros and inclusive of VAT) during the purchase process, in the Shopping Cart, in the Order Summary and, in any case, before the user proceeds with the transmission of the order and payment.
12.6 The user acknowledges that the acceptance of the delivery of the Admission Passes is his specific obligation. In case of non-delivery due to the absence of the recipient, the courier will leave a notice to document the delivery attempt (c.d. notice of passage). The notice will also contain the contact details where the user can contact the courier to agree upon a new delivery date to collect the Access Tickets. After the failed delivery attempt, the Tickets will be held in storage by the courier. The user is required to collect them within the term indicated by the Courier. In the event that the user does not withdraw the Access Tickets within this deadline, the Tickets will be returned to CED Digital where they will remain available to the Customer who, if he wishes, may request a new Home Delivery from CED Digital, subject to payment of the related costs. In no case, the failure to accept delivery of the Access Tickets will result in termination of the Contract.
12.7 During the purchase process, before the user transmits the order, the terms within which CED Digital undertakes to deliver the Access Titles, which are the subject of the user’s order, will be indicated.
Delivery terms must be considered from the date of conclusion of the Contract (i.e. the sending of the order), unless otherwise indicated. The delivery time for the specific order will also be indicated in the order confirmation. In the case of omitted indication of the delivery term, it will take place, in any case, within thirty days from the date of conclusion of the Contract.
12.8 In the event that the purchased Admission Passes are not delivered or are delivered later than the delivery date that was specified during the purchase process and in the order confirmation, the Customer may report the problem to CED Digital, contacting it at the addresses indicated in the “Contacts” section of the Website. CED Digital will reply to the report within 5 days of receiving it. Furthermore, the Customer, pursuant to art. 61 of the Consumer Code, may invite CED Digital to make delivery within an additional period appropriate to the circumstances (“Supplementary Term pursuant to Article 61, paragraph III, Consumer Code”). If this additional term expires without the Access Titles having been delivered, the user is entitled to terminate the contract (“Termination of the Contract pursuant to art. 61, III paragraph, Consumer Code”), without prejudice to the right to compensation of the damage.
12.9 In the event of Termination of the Contract pursuant to art. 61, paragraph III, Code of Consumption or Termination in Excluded Cases, CED Digital will reimburse the User the Total Amount without undue delay and, in any case, no later than 15 working days from the date of termination of the Contract, in the manner indicated art. 11 above.
12.10 It is up to the user to verify the conditions of the Admission Pass that has been delivered to him. Notwithstanding that the risk of loss or damage to the Tickets, due to reasons not attributable to CED Digital, is transferred to the Customer when the Customer, or a third party designated by him and different from the carrier, enters materially into possession of the Tickets. We recommend the Customer to verify that the received Tickets refer to the Main Services for which the Customer has purchased them as well as the correctness of the date, category, type and number of Access Tickets received. In the event of a mismatch between the access tickets received and those purchased, the customer can contact CED Digital.
12.11 The Customer is also highly recommended to verify that the package containing the Access Titles is intact, undamaged, wet or otherwise altered, and is invited, in its interest, to highlight on the carrier’s transport document, if there are any anomalies by ticking “unchecked goods” while accepting the packaging.
In fact, if the Customer does not specify this form of acceptance, he will not be allow to take legal action against the courier, in the event of loss or damage to the Tickets, except in the event that the loss or damage is due to malice or gross negligence of the courier itself and except for partial loss or damage not recognizable at the time of delivery, provided that in the latter case, the damage is reported as soon as known and no later than eight days after receiving it. If the package shows obvious signs of tampering or alteration, it is recommended that the Customer also promptly notify CED Digital by contacting it at the addresses indicated in the “Contacts” section of the Website.
12.12 CED Digital may also offer the user the delivery by the use of Immediate Print, which allows the Customer to immediately print the Access Tickets purchased with the help of a normal printer. The user is reminded that, in any case, in order to take advantage of the “Instant Print” delivery mode, the user must use a PC on which the “Adobe Acrobat Reader” program is installed and updated.
12.13 The Customer who, whether available, has chosen “Immediate Print” as delivery method can proceed to print the Tickets immediately after their purchase or subsequently, accessing to his account through his own credentials. If the Customer encounters problems in printing the Access Tickets, he may contact the CED Digital Customer Service.
12.14 The access control system will authorize the entry of a single Access Ticket, which is equivalent to a single barcode. Any photocopies and / or frauds resulting from an improper use of the same will be punishable by law and not attributable to CED Digital or the Organizer. The Organizer will not allow in any case the access of any duplicate Access Titles.
13. Right of withdrawal
13.1 CED Digital informs the Customer that the Tickets issued by Opera Romana Pellegrinaggi, also through CED Digital, they are not reimbursable by the Organizer’s policy. and for the services covered by the Contract there is no right of withdrawal.
13.2 Without prejudice to the above, the right of withdrawal is excluded for services related to free time that the Organizer undertakes to lend in a specific date or period, pursuant to art. 59, paragraph I, letter n) of the Consumer Code. For passenger transport services, the withdrawal is also excluded from the art. 47 letter m) of the Consumer Code. The right of withdrawal is also excluded by the art. 59 letter a) of the Consumer Code as the CED Digital Services are provided, with the consent of the Customer, immediately after the purchase order.
14. Access Tickets and Main Services
14.1 All Admission Passes Holders must be in possession of a valid Admission Pass to use the Main Services.
14.2 The Admission Pass is the title for using exclusively the Main Service for which the pass was issued, on the day and time indicated therein. The Organizer has the right to refuse access to the Main Service if the Admission Pass is irregular and it can carry out checks on the person for security reasons.
If the Admission Pass was found to have been stolen, duplicated or obtained in conflict with these GTCs and / or the law, the holder of the Admission Pass will not be authorized by the Organizer to use the Main Service and will be forced to leave it. In any case, CED Digital will not replace the Admission Ticket if it is lost, missing, deteriorated, damaged, destroyed, partially illegible or not perfectly intact or if the Admission Pass has been stolen.
14.3 CED Digital may, at any time, cancel at the request of the Organizer and / or the authorities responsible for protecting the order and public safety, for technical and / or organizational reasons other than those referred to in art. 15 below, an Access Ticket already issued or a purchase order relating to an Access Ticket already made. In this case, the Customer will be entitled to reimbursement of the amount paid, excluding the cost of Home Delivery, if the shipment of the Admission Ticket has already taken place at the time of the cancellation of the order and / or of the Admission Pass.
14.4 CED Digital is in no way responsible for the correct performance of the services to be paid by the Organizer, necessary for the use of the Admission Pass.
15. Postponed or Canceled Main Service
15.1 CED Digital is not, in any case, responsible for any cancellation or suspension of the Main Service by the Organizer. If the Main is canceled or suspended by the Organizer, CED Digital will notify the Customer, in the name and on behalf of the Organizer, of the decisions made by the Organizer in relation to the reimbursement or replacement of the Access Tickets regarding the postponed or canceled Main Service.
We remind the Customer that, in the event of cancellation of the Main Service, the Organizer reserves the right to withhold any pre-sales rights and that, also in this case, CED Digital is completely extraneous to the Organizer’s decisions.
15.2 Without prejudice to what the previous point 16.1 explained, if a Main Service is suspended or canceled by the Organizer, under no circumstances may the Client ask CED Digital to reimburse the costs of Home Delivery or Delivery by Immediate Print and / or the cost of the gift package and / or any insurance coverage premium, if incurred.
15.3 If a Main Service is suspended or canceled, CED Digital will proceed with the reimbursement to the Customer, in the manner and with the timing decided by the Organizer, only if CED Digital has been specifically delegated to such reimbursement and has received from the Organizer the necessary funding. In case of cancellation and / or postponement of the Main Service, the Customer may still contact the Organizer, to enforce all his rights against the same.
15.4 The Tickets for the Main Services that were canceled or suspended cannot be exchanged with Tickets for other Events.
16. CED Digital Limitations of liability and rights
16.1 Except in the case of willful misconduct or gross negligence, CED Digital should not be held liable for any direct or indirect expenses and damages of any nature suffered by the Customer in connection with the sale of Access Tickets.
16.2 CED Digital should not be held responsible for the case of malfunctions or blackouts of the website, unless they depend on intent or gross negligence.
16.2 CED Digital reserves the right to withdraw, modify, suspend or interrupt any function or service provided by the same in relation to the sale of the Admission Passes, where this is necessary or appropriate for technical and / or organizational reasons, without prejudice to the fulfillment of the Contract already concluded.
17. Prohibitions
17.1 The Admission Passes shall not be resold for money during the professional development of commercial activities, even if organized in the form of an enterprise, without the express consent of the Organizer and in all the cases when the Organizer specifically prohibits the transfer of ownership, based on its principles of nomination.
17.2 Furthermore, the Admission Passes shall not represent the prize for prize events, falling or not falling within the scope of application of Presidential Decree 430/2001 or of other prize-giving or promotional initiatives (such as, for example, competitions or lotteries). There shall be prizes only in the case of prior written authorization issued by the Organizer or by CED Digital, if so, it is authorized by the Organizer.
The Customer acknowledges that he will not use the Tickets in violation of this provision and expressively undertakes to keep CED Digital harmless from any damage that may derive from the violation of this warranty.
18. Assistance and Complaints
18.1 It is possible to request information, send communications or complaints by contacting CED Digital customer service at the addresses indicated in the “Contacts” section of the Site.
19. Personal data
19.1 CED Digital will be the data controller for the personal data of the Customers. This data includes the name and contact details indicated by the Customer upon registration. The data will be processed as indicated in the Privacy Policy available at the link romevaticancard.com/privacy-e-cookies.
20. Applicable Law and Jurisdiction
20.1 The Contract related to CED Digital services is subject to Italian law.
20.2 We remind you that, in the event of a Consumer user, the court of the place where the user resides or has elected domicile is competent for any dispute relating to the application, execution and interpretation of these Terms and Conditions.
20.3 In any case, the rights of Consumers users to bring an action before the ordinary judge competent for the dispute arising from the Contract, and, where the necessary conditions exist, to promote an out-of-court resolution of disputes relating to consumer relationships through the use of procedures referred to in Part V, Title II-bis of the Consumer Code are excluded from these rights.
20.4 The Opera Romana Pellegrinaggi (for brevity also O.R.P.) is an institutional activity of the Vicariate of Rome, Organ of the Holy See. The services of which Opera Romana Pellegrinaggi is an Organizer may be subject to the laws of the State of Vatican City.
